These Terms of Service ("Terms") govern your use of the bsuite AI platform and services (the "Service") operated by bsuite AI ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

bsuite AI is an AI-powered messaging platform that connects to your Instagram Business or Creator account, Facebook Page (Messenger), and WhatsApp Business account via official Meta APIs. The Service reads incoming direct messages, generates AI-suggested replies using Claude AI (by Anthropic), and sends approved replies back through the original messaging channel.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at info@bsuiteai.com if you suspect unauthorized access.

4. Meta Platform Integration

4.1 Authorization

By connecting your Meta accounts, you authorize us to access and process messages, account information, and related data through Meta's APIs as described in our Privacy Policy. You may revoke this access at any time through your dashboard settings or through Meta's app permissions.

The Service respects Meta's messaging rate limits (including the per-account limit of 180 messages per rolling hour). Messages exceeding these limits are queued and sent when capacity becomes available. We are not responsible for delays caused by Meta's rate limiting or API restrictions.

5. AI-Generated Content

5.1 Nature of AI Replies

The Service uses Claude AI (by Anthropic) to generate reply suggestions based on your configured instructions and incoming messages. AI-generated replies are suggestions and may contain inaccuracies, inappropriate responses, or errors.

5.2 Your Responsibility

You are solely responsible for all messages sent through the Service, whether AI-generated, human-edited, or manually composed. This includes messages sent via Auto-Reply mode. We recommend using the human approval workflow to review AI replies before they are sent.

5.3 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or appropriateness of AI-generated replies. The AI may hallucinate information, misinterpret intent, or generate responses that do not align with your brand. You should review and verify AI outputs, especially for critical communications such as pricing, legal commitments, or medical information.

7. Subscription and Billing

7.1 Plans

The Service is offered under tiered subscription plans (Free, Starter, Pro) with varying limits on connected accounts, AI token budgets, team members, and conversation history retention. Plan details are available on our website.

7.2 Payment

Paid subscriptions are billed monthly or annually via Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are in USD and are non-refundable except as required by law.

7.3 Token Limits

Each plan includes a monthly AI token budget. If you exceed your token budget, Auto-Reply is disabled until the next billing cycle. Manual replies remain available. You can upgrade your plan at any time to increase your token budget.

7.4 Free Trial

We may offer a free trial period. At the end of the trial, you will be billed at the applicable plan rate unless you cancel before the trial ends.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Intellectual Property

9.1 Our IP

The Service, including its design, features, code, and documentation, is owned by bsuite AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9.2 Your Content

You retain ownership of your content, including AI instructions, custom replies, and business information you provide. You grant us a limited license to use this content solely to provide and improve the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated replies will be accurate or suitable for your needs.

11. Limitation of Liability

To the maximum extent permitted by law, bsuite AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business, or data loss, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless bsuite AI, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) messages sent through the Service, including AI-generated replies; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable laws.

13. Termination

You may cancel your account at any time through your dashboard settings. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the modified Terms. For significant changes, we will also notify you via email.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
